USITC Initiates Section 337 Investigation into Disposable E-Cigarettes | List of 35 Respondents Included

On July 17, the U.S. International Trade Commission (USITC) voted to initiate an investigation into certain disposable vaping (e-cigarette) devices. The products under investigation are detailed in the commission’s notice of investigation.

The investigation is based on a complaint filed on June 11, 2024, by RAI Strategic Holdings, Inc., RJ Reynolds Vapor Company, RJ Reynolds Tobacco Company, and RAI Services Company, all based in Winston-Salem, North Carolina. The complaint was supplemented on June 12, 2024, and July 1, 2024.

It is noteworthy that the aforementioned companies—RAI Strategic Holdings, Inc., RJ Reynolds Vapor Company, RJ Reynolds Tobacco Company, and RAI Services Company—are all subsidiaries of Reynolds American Inc. (RAI).

The supplemented complaint alleges that the importation and sale of certain disposable vaping devices in the U.S. violate Section 337 of the Tariff Act of 1930, as these devices infringe upon a patent asserted by the complainants. The complainants are requesting that the USITC issue a general exclusion order or a limited exclusion order, as well as cease and desist orders.

The USITC has identified the respondents in this investigation, totaling 35 entities:

By initiating this investigation (337-TA-1410), the USITC has not yet made any decision on the merits of the case. The USITC’s Chief Administrative Law Judge will assign the case to an Administrative Law Judge (ALJ), who will schedule and hold an evidentiary hearing. The ALJ will make an initial determination on whether there is a violation of Section 337; this initial determination is subject to review by the commission.

The USITC will make a final determination in the investigation at the earliest practicable time. Within 45 days after the investigation begins, the USITC will set a target date for completing the investigation. Remedial orders in Section 337 cases become effective upon issuance and become final 60 days after issuance unless disapproved for policy reasons by the U.S. Trade Representative within that 60-day period.
